Almost forgot to mention this… a group of spammers were convicted and a judgment for ONE BILLION DOLLARS was entered against them. This is no Dr. Evil bologna. This is for real. The best part – I knew what the article was talking about when it said:
U.S. District Judge Charles R. Wolle filed the default judgments Friday against three companies under the Federal Racketeer Influenced and Corrupt Organizations Act and the Iowa Ongoing Criminal Conduct Act…
Default judgment = the defendants failed to respond properly to court documents and basically waived their right to defend themselves. This often happens when they DON’T SHOW UP TO COURT, THE MORONS.Federal Racketeer Influenced and Corrupt Organizations Act = aka RICO = an act designed in response Jimmy Hoffa and the construction of Las Vegas with illegal Teamster funds. There was a famous mafia movie with a character named Rico, and the Feds liked the name so much they decided to design the name of the Act around it. Hence, RICO. Yes, folks, Feds are geeks too. So what can be considered a RICO offense? Everything, more or less. If a mafia organization can do it, it can fall under RICO. That way, the Feds can get pretty much anyone doing anything under RICO.
Iowa Ongoing Criminal Conduct Act = I have no freaking clue. I go to law school in Texas, man. Probably has something to do with preventing ongoing criminal conduct, maybe?

yeah, the judgment is for $1B, but $1B will certainly not change hands. the article goes on to say: --- "Kramer is unlikely to ever collect the large judgment, which was made possible through an Iowa law that allows plaintiffs to claim damages of $10 per spam message, said his attorney, Kelly O. Wallace of Atlanta. "We hope to recover at least his costs," Wallace said. Kramer's lawsuit was originally filed in October 2003 against 300 defendants then known only as John Does." since there were so many unidentified spammers, there's no telling what will happen to them all. i think an injunction stopping them from spamming would be in order, but the article didn't mention that. they do have a chance to appeal, but the appeal does not have to be granted, of course. it all depends on what in particular about the case is appealed and what the judge wants to do. and for those of you still craving that penis enlarger, i suggest you team up with cherz. if anyone has what it takes to track down some spare leftovers after the holiday season, he's your man.

This is heartening. I like that spammers have one billion dollars to pay, the bastards. But here's a question for you: what happens now? I'm guessing the guy with a warehouse full of penis enlargers is no billionaire. Do they have a chance to appeal? Or do they just hand over the penis enlargers and declare bankruptcy? Also, who gets the money if they pay up? (Or, if their assets are confiscated, what happens to all those penis enlargers?)
